GENERAL TERMS AND CONDITIONS OF SALE

In this section you will find all the legal information governing the access and use of the Cooperativa Agricoltori Vallata di Levanto’s website and online Shop.

Accessing and using this website, as well as purchasing our products online, implies the reading, acknowledgement and acceptance of the following General Conditions of Sale by the User.

We therefore invite you to check this section to read the most recent and updated General Conditions of Sale on a regular basis and prior to making any purchase.

SCOPE

These General Conditions of Sale ("Conditions") govern the sale of Products and services through the website and form an integral part of each sales agreement ("Agreement") that is concluded via the internet between:

  • • The Cooperativa Agricoltori Vallata di Levanto VAT N./C.F. 00242470110 REA SP64637 Via San Matteo, 20 Location Le Ghiare 19015 Levanto (SP) Italy (“The Seller”)
  • • and any person or entity who purchases Products or services from the website www.coopagricoltorilevanto.it (“The Customer”).

Any purchase order for Products on our website is governed by these Conditions, without prejudice to the Seller's right to apply different and particular conditions.

The applicable Conditions are those in force at the time of placing an order.

The Cooperativa Agricoltori Vallata di Levanto reserves the right to amend these General Conditions of Sale at any time, without prior notice.

ORDERS

The Customer undertakes, before proceeding to confirm their Order, to read these Conditions and to accept them by ticking in the relevant box.

By placing an Order through the site, the Customer guarantees both that they possess the necessary capacity to act and conclude legally binding contracts, and that they are over 18 years of age.

Customers who place orders through the site accept the Terms and Conditions in accordance to the following.

The Seller offers its Products for sale within the limits of stock availability at the time of the Purchase Order.

Information on the Products on the Site, such as technical specifications, look, size, etc. are not binding and may be subject to change at any time.

To complete the Order, the following formalities must be fulfilled:

  • 1. The Customer reads, acknowledges and accepts these Conditions;
  • 2. The Customer fills up the Order Form by entering all the required data;
  • 3. The Customer completes Payment, in favour of the Seller, which includes the price of the purchased product(s) and the shipping costs;
  • 4. The Seller receives an electronic receipt of the aforementioned Order Form.

The correct receipt of an Order is confirmed by the Cooperativa Agricoltori Vallata di Levanto by e-mail sent to the e-mail address supplied by the Customer in the Order Form.

This confirmation is generated automatically by the system and cannot be considered as an acceptance of the Order itself, but only as a confirmation that the Order Form has been received.

Following receipt of an Order, the Cooperativa Agricoltori Vallata di Levanto will check the availability of the Products ordered and, only following this verification, it will communicate that the Order has been accepted, by sending the customer a receipt of acceptance of the Order.

Once the Order acceptance receipt has been forwarded to the Customer, it will no longer be possible to amend or cancel the Order.

Unless otherwise indicated, the prices of the Products must be regarded as inclusive of VAT. The prices of the Products published on the site over time cancel and replace the previous ones; the Customer may pay for the Products ordered using one of the payment options stated on the website.

In the event of issues, the customer can cancel the Order by sending an email stating their willingness to cancel to the address info@coopagricoltorilevanto.it

SHIPMENTS

Orders are processed Monday through Friday; the Products purchased by the Customer will be shipped via courier, to the address supplied by the Customer. Shipment will be arranged approximately within five working days from the acceptance of the Order.

Should the Products be shipped outside of the Italian national borders, the Customer is responsible for paying any import charges and taxes, as well as any duties and customs duties provided for by the legislation in force in the territory of destination of the Products.

Any damage to the packaging and / or Products, or a mismatch in the number of packages or indications, must be immediately reported to the courier through specific indication on the delivery document.

RIGHT OF WITHDRAWAL AND RETURNS

The Customer can exercise the right of withdrawal within 14 calendar days from the date of receipt of the goods by means of a written communication to be sent to: Cooperativa Agricoltori Vallata di Levanto, Località Le Ghiare, Via S. Matteo, 20 19015 Levanto SP by registered mail with return receipt, or by e-mail to (info@coopagricoltorilevanto.it).

This communication must contain all the data needed to clearly identify the order, a declaration of the willingness to renounce the purchase, and details of the Product or Products for which the right of withdrawal is to be exercised,  and shall contain an attached copy of the relevant tax document issued with the purchase  (invoice or receipt). In case of exercise of the right of withdrawal, the Customer undertakes to returning the Products to the same address used for the registered mail in unaltered conditions and in the original packaging.

The right of withdrawal cannot be exercised in case of: purchase of bespoke or customised Products from the Cooperativa according to specifications requested by the Customer or of items which, by their nature, cannot be returned or are due to deteriorate or expire rapidly; Products not delivered due to the absence of the Customer from the place of delivery, and Products that, at the time of their collection, are altered or damaged due to the delay in the delivery caused by the Customer. If the withdrawal is made according to the methods and terms mentioned above, any amount already paid for the Products is credited back to the Customer by bank transfer to an account in their name.

The costs for returning the Products to the Cooperativa Agricoltori Vallata di Levanto are non-refundable and the Customer is required by law to cover for them.

For the solution of civil and criminal disputes deriving from the conclusion of this distance sales agreement, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of their town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of La Spezia.
